Timmy B asked:

I live in Maryland. I have 3 jobs.

One job is in Maryland but I only work there about 8 hours a week waiting tables.

My other two jobs are in Pennsylvania and I get a total of a little over 40 between the two of them.

What will the consequences of this be when I am filing my taxes here in a few months? Are there anyway to avoid this?

My next question is, would it be better to change my residency or is it too late in the year?

  • Judy:

Since you are working in two states that have state income tax, you’ll have to file state returns both places. This is no matter where your residency is. If you move from one of the states to the other, you’d file in each as a part year resident. Otherwise you’ll file where you live as a resident, and in the other state as a non-resident.

    Two additional points:
    1. You can’t (legally) just “change your residency”, unless you actually move.
    2. In general, you won’t pay tax twice on the same income. You should be able to offset taxes paid to one state on the other state return.
